History 101: Wilbert McClure (October 29, 1938 – August 6, 2020) was an American professional boxer. As an amateur he won gold medals in the light middleweight division at the 1959 Pan American Games and the 1960 Olympics. As a professional he competed from 1961 to 1970.McClure earned degrees in literature and philosophy in 1961 from the University of Toledo and a doctorate in psychology from Wayne State University in Detroit in 1973. He later became a Massachusetts state boxing commissioner. He was honored in August 2012 for his life's work by the Charles Hamilton Houston Institute for Race and Justice at Harvard Law School.McClure was found guilty in Wilson v. McClure et al, the first legal case in the US to reach a federal court jury to challenge the concept of same-race discrimination in September 2000. The case was brought by race-black licensed boxing promoter Zeke Wilson against a state sports commission headed by the race-black chairman for damage reparations and punitive redress after his right to conduct professional boxing events was violated.In this case, race-white boxing commissioner William Pender performed direct discriminatory acts, while the race-black commission chairman Wilbert McClure failed to provide the promoter sufficient protection under his authority and cooperated in the unjust cancellation of a series of boxing events, causing financial harm to the promoter. A unanimous jury verdict found that the race-black Chairman was guilty of racial discrimination along with race-white Commissioner William Pender and both defendants were assessed punitive damages in addition to the compensatory damages awarded by the jury.The precedent-setting case is the subject of the non-fiction book, The Eighth Round.     Are boxing matches between “influencers” lawful? The recent decision of Acting Judge le Grange in Tikbox League (Pty) Ltd and Others v Du Toit and Others (B1342/2023) [2023] ZAGPPHC dealt with this question. The case underscores the contractual principle of lawfulness, a cornerstone of any valid agreement, which requires that the agreements we enter into are founded upon the solid ground of legal permissibility. The court determined that an agreement to host boxing match events between “influencers” (essentially members of the public) did not comply with applicable legislative requirements, was against public policy, and therefore unlawful and unenforceable, even though the participants in the boxing match purportedly consented thereto.The court emphasized that no person can simply consent to pure assault and that there must be some or other legal justification for applying intended bodily force to another. The court referred the matter to the Companies and Intellectual Property Commission to consider whether the purpose of Tikbox League (Pty) Ltd is lawful, and if not, to address the issue accordingly. The case accentuates the requirement that commercial arrangements must be lawful to be valid, and so too should the purpose or objective of a company.     When the CEO is a legal and financial liability...Friends, here's what UFC CEO Dana White said on Saturday, Dec. 2 when asked about #PFL's acquisition of Bellator:"It's f*cking hilarious... One sh*tty organization that sells no tickets and nobody watches buys another sh*tty organization that sells no tickets and nobody watches. Sounds like a f*cking winner to me, boy. Right? Wooo!"Two facts:(1) The new combined PFL + #Bellator entity is clearly the No. 2 MMA promotion in the world behind the UFC.(2) As part of an ongoing class action antitrust lawsuit against #UFC operator Zuffa LLC, the defendant's lawyers are tasked with arguing in court that the UFC is *not* an illegal monopsony with an anticompetitive stranglehold over the market for MMA talent.This isn't a two-things-can-be-true proposition. These postures are directly contradictory -- and only one will win out in federal court.This is where the idea that "Dana White is a great businessman" requires more nuance than we tend to give it. He is a great (if not all-time) showman/marketer. BUT, as it relates to the minutiae and crucial maneuverings behind the scenes to ensure the future health of the enterprise that none of us see as fans, he's far more of a china shop bull like Donald Trump than a slick assassin like Vince McMahon.In other words, he's not exactly doing his own company's lawyers any favors, but he can't help it.     Conor McGregor: a better fighter or businessman?It's difficult to find the exact numbers on McGregor due to undisclosed figures, but it's estimated that he has brought in an average of $37 Million per year over his career from his UFC fights and cross-over boxing bout against undefeated champion Floyd Mayweather. (The boxing match in 2017 was one of his biggest individual paydays.) On the other hand, when McGregor sold his majority stake in the Proper 12 Whiskey brand in 2021, the deal was reported to have fetched around $600 million.
